Levy On Gaming Machines - Supreme Court of Victoria Judgment
MELBOURNE, Victoria (June 24, 2013) -- The Supreme Court of Victoria has today ruled in favour of Tabcorp Holdings Limited in relation to proceedings it commenced on 16 May 2013, challenging a Victorian Government determination in respect of the Health Benefit Levy ("HBL") on its gaming machine operations.
The Victorian Government had applied the HBL for the 2013 financial year without regard to the fact that Tabcorp ceased to operate gaming machines on 15 August 2012.
The Court has decided that the Victorian Government does have a discretion under the Gambling Regulation Act 2003 (Vic) to calculate the HBL on a pro rata basis.
Tabcorp notes that the matter will now revert to the Victorian Government to make a new determination in respect of the HBL. Tabcorp intends to submit to the Victorian Government that the discretion should be applied to calculate the levy on a pro rata basis, referable to the 46 days Tabcorp operated gaming machines in the 2013 financial year.
